Les frais de mutation, encore appelés "frais de notaire", sont strictement réglementés. Ces frais comprennent : la rémunération du notaire, ses émoluments "proportionnels" déterminés selon un barème en fonction du prix de vente, ses émoluments fixes (ou émoluments de formalités) correspondants aux actes et démarches administratifs effectués par lui et pour votre compte.

Comment se fait le calcul :

  • Honoraires du notaire : fixé par décret, le taux de rémunération des honoraires du notaire varie en fonction du prix de vente du bien. Ce prix est sectionné par tranches, et à  chacune d'elles correspond un pourcentage d'honoraires. Ainsi, pour une maison de 120 000 €, vous paierez 4 % d’honoraires pour la tranche allant jusqu’à  6 500 €, puis de 6500 jusqu’à  17 000 € vous paierez 1,65 %, et jusqu’à  30 000 € vous paierez 1, 10 %. Au-delà, le taux est fixé à  0,825 %. Soit : 260 € pour la première tranche, 173,25 € pour la seconde, 143 pour la troisième et 742 € pour la dernière. Au total, les honoraires du notaire s’élèveront 1577, 23 € TTC.
  • Emoluments proportionnels : ils sont indexés sur le prix de vente du bien. Ainsi, on estime que pour une acquisition d’une valeur de 200 000 €, ceux-ci s’élèvent à  environ 0,99% du prix.
  • Emoluments de formalité : Chaque action du notaire a un coùt bien précis qui, lui aussi, est fonction de la valeur du bien. Pour reprendre notre exemple de la maison de 120 000 €, les démarches à  l’Etat civil s’élèveront à  9, 83 €, 19,67 € pour un extrait d’acte…
  • Débours : ce sont des frais que le notaire doit payer à  des tiers .(cadastre, hypothèque, géomètre…) et que vous devrez intégralement rembourser sur facture ou selon un barème le cas échéant.

Demandez un devis détaillé à  votre notaire avant la signature de l'acte de vente. Et si votre emprunt est garanti par une hypothèque, intégrez aussi la rémunération du conservateur des hypothèques (0,10 % du montant du bien) !
